PRESS RELEASE
AACTS Malta expresses serious concern over proposed constitutional amendment on the environment
The Association of Arms Collectors and Target Shooters (AACTS Malta), together with its members, athletes, and affiliated clubs, reaffirms its full commitment to the responsible and safe practice of target shooting in Malta. Our community has always operated with strict adherence to national regulations and the highest standards of safety and environmental responsibility.
However, AACTS Malta expresses serious concern regarding the proposed amendment to the Constitution of Malta (Article 45A), currently before Parliament. While the stated objective of the amendment is to strengthen environmental protection, an aim we fully support in principle, the wording of the proposed provision is so broad and unqualified that it risks creating legal uncertainty and potential harm to legitimate sporting and recreational activities, including target shooting.
The proposed amendment would allow any individual, even without personal or direct interest, to initiate legal proceedings on environmental grounds. Such a measure opens the door to frivolous, vexatious, or politically motivated claims, which could be used to disrupt lawful and well-regulated sports, including the activities of shooting ranges and target shooting clubs. The inclusion of provisions enabling the courts to impose interim measures, such as immediate suspensions, raises the further risk that competitions, training, or the use of shooting facilities could be halted abruptly, even before a case is properly heard or adjudicated.
AACTS Malta is equally concerned that this amendment was introduced in Parliament by the Nationalist Party without prior consultation with any of the stakeholders or communities who may be directly affected by it. Given the potential implications for minority sports, cultural practices, and law-abiding enthusiasts, such a lack of engagement with the sporting and civil society sectors is deeply disappointing. Major constitutional reforms, particularly those that may alter citizens’ rights and freedoms, should be developed through broad consultation and transparent dialogue, not through unilateral political initiatives.
AACTS Malta strongly believes that environmental protection and responsible sporting practice are not in conflict. Indeed, the target shooting community has long demonstrated respect for the natural and social environments in which its sport is conducted, investing in safe, purpose-built facilities that meet national and European standards.
We therefore urge Members of Parliament from all sides to:
I. Ensure that any constitutional amendment provides clear safeguards against abuse and vexatious litigation
II. Recognize the rights of all citizens, including those engaged in minority and recreational sports, to continue lawful activities without fear of arbitrary disruption; and
III. Engage in genuine consultation with all affected stakeholders before proceeding with any constitutional changes of this significance.
AACTS Malta remains ready to participate constructively in any consultation process aimed at achieving a fair and balanced constitutional framework, one that protects both the environment and the rights of responsible citizens who contribute positively to Malta’s social, cultural, and sporting life.
